This application is made by the applicant(s) requesting for allotment of the unit in the
project as mentioned above.
This ‘Application for Booking’ cannot be interpreted as “Letter of Allotment” or
commitment to allot the unit by the Company. The allotment shall be subject to the terms
and conditions herein and subject to realization of all the payments made to the Company
from the Applicant(s).
Persons other than Indian Citizens, NRI and PIO without RBI permission are not eligible
to hold immovable properties in India.
Persons not competent to enter into a contract under the Indian Contract Act, 1881 shall
not be eligible to apply.
All references to Company in this Application shall mean either Century Real Estate
Holdings Private Limited and/or its Promoters and/or its associates/subsidiaries.
All fields in this application form need to be filled completely. Incomplete application
forms will be rejected.
Self-attested proof of address, Aadhaar Card copy, PAN card copies and Passport size
photo of the Applicant(s) needs to be attached along with this Application.
All the communication sent by the Company to the applicant at the physical address &
email address mentioned in the application form shall be deemed to have been received by
the applicant either by e-mail or by another form of communication.
It is the sole responsibility of Applicant(s) to provide updated information (if any) to
the Company from time to time.
Company shall continue to correspond with the applicant at the physical address or email
address mentioned in the application unless the change of address is given in writing
and changed address is confirmed by the Company. Any such communication returned to the
Company for whatever reason is deemed as received by the applicant and the applicant
agrees to abide by the content of such communication.
This booking/application is tentative, subject to acceptance by the Company and
credit/realisation of the booking amount of 9.9% of the Total Sale Consideration.
The Applicant(s) has been informed and is fully aware that the Booking Amount & Payment
details for the flat/apartment/plot(Unit) will be as per the mutually agreed & signed
cost sheet and the Applicant(s) has to pay the Booking Amount i.e., 9.9% of the Total
Sale Consideration of the Unit (less the Booking Token and/or EOI amount, if any) by way
of Post-Dated Cheque (PDC) dated no later than 15 (fifteen) days from the date of this
Application/ Booking date.
The Applicant(s) will not question the sale price of unsold units or of any other
purchasers nor will the Applicant(s) be entitled to compare the sale price with other
purchasers.
Agreement For Sale:
The Applicant(s) agrees to execute and submit to the Company the Agreement for
Sale as per the standard format (shared by the Company) within 25 days from the
booking date.
Delay in the payment of monies by the Applicant(s) beyond the due date as
mentioned in the above clause, shall attract delay interest at the rate of
prevailing SBI MCLR + 2% per annum, which will be calculated on a daily basis
commencing from the date it fell due until realization of payment.
In case the Applicant(s) fails to make the due payments and submit the duly
signed Agreement for Sale within the prescribed duration (or any extended
period), the Company, at its sole discretion, shall revise the price and/or
cancel the booking/allotment/agreement and forfeit the Booking Amount plus all
taxes, levies and statutory levies of whatsoever nature already remitted to
government by the Company for the flat/plot booked and/or on behalf of
Applicant(s), as these charges cannot be recovered by the Company. After
intimating the cancellation, the Company is entitled to re-allot and resell the
Unit to any other Applicant(s) and on such terms and conditions as the Company
deems fit.
The Applicant(s) upon execution of Agreement for Sale and/or Construction
Contract, the terms and conditions mentioned in the Agreement for Sale and/or
Construction Contract shall be binding on both, the Company and the
Applicant(s), superseding the terms and conditions in this Application.
The applicant(s) has/have inspected the location of the project and having been
satisfied with the location and specifications of the Project, have signed and submitted
this application to the Company.
Transfers, without a transfer fee, are allowed only among immediate family members
(father/mother/spouse/son/ daughter). In case of transfer to any other persons, will be
subject to the consent of the Company in writing and if consented, a Transfer Fee of 10%
of Total Sale consideration will be applicable. The assignment/transfer is allowed only
after a minimum clearance of first three installments.
The Company reserves the right to cancel the booking and forfeit monies paid, if the
amounts are not paid as per the terms of this Application. In case the Applicant(s)
desires to withdraw the application, the entire Booking amount paid will be forfeited as
cancellation charges.
In addition to the Total Sale Consideration, additional charges such as applicable taxes
as on the date of registration of conveyance deed, advance maintenance charges,
maintenance corpus fund etc., are payable by the Applicant(s).
Until the entire Total Sale Consideration and other additional charges is paid by the
Applicant(s), The Company shall have the first lien on the unit.
Statutory expenses like Stamp Duty, Registration Fee and legal, stamping, incidental
expenses for registering the property documents will have to be borne by the
Applicant(s).
Applicable TDS, is required to be deducted by the applicant and be remitted with the
department immediately on behalf of the Company. Post remittance the Applicant(s) shall
submit the duly signed Form 16B to the Company.
The applicant(s) agree that only written and signed commitments by authorised personal
of the Company shall be binding on the Company.
Delivery date indicated is subject to the “Force Majeure” clause detailed in agreement
of sale. Dimensions and details provided in the accompanying literature are approximate
and are subject to alteration without any notice. The structures shown in the prospectus
are conceptual designs and may vary at the time of execution. The location of the
facilities is subject to change, depending upon the Architects advice for better
planning.
Changes in standard specifications by the Applicant(s) are not acceptable, as changes
adversely affect the completion schedule of the Project.
The Company has no control on all the developments that may exist or take place in
future whatsoever, in the adjoining property of the project.
The Applicant(s) agrees that in case the Company decides not to go ahead with the
project for any reason whatsoever, such decision of the Company shall be final and
binding and cannot be disputed. In such event the Company will refund the amount paid by
the Applicant(s) without interest or compensation within 3 months or such other extended
time from the date of decision of the Company not to execute the project.
In case of any disputes arising between the Company and the Applicant(s) in respect of
this Application the jurisdiction for all such disputes shall be Bangalore city.
The Applicant(s) has read and understood the terms and conditions, including the details
of specifications of the project contained in the brochure/ details provided by the
Company.
In case the Applicant(s) is not satisfied with any issues till the signing of the
